Air source heat pump Terms and Conditions

Key terms

1.       Agreement

The ‘Agreement’ means collectively the Terms & Conditions and your quotation. The Agreement is a legally binding contract between yourself and E.ON Energy Installation Services Limited.

2.       Services

We will (a) use all reasonable care and skill when providing the services detailed within our quotation and Works and (b) ensure that any goods provided in line with the quotation are suitable for the specified purpose.

3.       Price

You will pay the price for the Installation Works as set out in your quotation and at the times set out in your quotation, or as agreed between us and confirmed in writing.

4.       Your right to cancel

You do have a 14 day cooling off period if you wish to cancel this Agreement, please get in touch by either:  completing the cancellation form (provided in Schedule 1) or notifying us in writing of your cancellation and sending this to either (a) E.ON Energy Installation Services Ltd, Westwood House, Westwood Business Park, Coventry, CV4 8LG; (b) solutionssupport@eonenergy.com or (c) phoning us on 0345 366 5981.

5.       Processing your data

If you provide any personal data to us under this contract E.ON Energy Installation Services Limited will be the ‘data controller’. Our Data Protection Officer can be contacted at Newstead Court, Little Oak Drive, Annesley, Nottinghamshire, NG15 0DR.

We will process your personal data in accordance with our privacy notice, as amended from time to time, which can be found at eonenergy.com/privacy or by contacting us to request a paper copy. Our privacy notice sets out:

·         where we might get data about you from;

·         why we need it;

·         what we might do with the data (including who we might share it with);

·         the circumstances in which your data might be transferred abroad; and

·         how long we keep it for

6.       Standard of service

If we don’t deliver the standards of service you reasonably expect, we want to know about it so we can try and put it right. Email us at ESUK-Customer-Concerns-E.ON@eon-uk.com to discuss your query/complaint. We’ll  assess your complaint and try to  resolve things to your satisfaction. If we can’t resolve your complaint, there and then we’ll carry out a full review and respond to you within eight weeks.

7.       Boiler Upgrade Scheme (BUS)

The Boiler Upgrade Scheme is part of the Government’s plan to reduce carbon emissions, the scheme which will be administered by OFGEM aims to reduce carbon emissions by providing a grant towards the costs of installing an Air Source Heat Pump. 

E.ON will carry out the works described in your quotation. 

What is included in your installation

We will:

  • carry out a full technical design and installation for your Air Source Heat Pump to the Heat Pump Design and Installation standards MIS 3005-D and I  in accordance with the  Microgeneration Certification Scheme (MCS) 
  • install your Air Source Heat Pump (ASHP) to manufacturer’s instructions
  • decommission and remove your existing central heating and hot water system were applicable
  • install and commission refrigerant pipework (where applicable)  
  • install a hot water cylinder (where applicable) with associated safety controls to manufacturer’s instructions
  • install heating and hot water controls compatible with your heat pump  
  • make the appropriate application to your electricity Distribution Network Operator (DNO) prior to installation although any associated costs will be your responsibility 
  • issue all certification as required by building regulations on completion of the works
  • insulate all pipework in line with manufacturer’s instructions 
  • encase cabling in trunking where practicable and in line with building regulations 
  • commission all equipment as per manufacturer’s instructions
  • provide a handover pack compliant to MCS requirements  
  • issue you with ASHP warranty documents
  • Issue you with Building Notification Certificates applicable to the works we have completed as specified in the quote
  • register your ASHP with the manufactuer to trigger the warranty.

Details of what is not included in your installation

We will not:

  • remove oil tanks or liquid petroleum gas (LPG) containers  
  • undertake, organise or co-ordinate of any future servicing requirements  
  • obtain Planning Permission if this is required for the installation of your ASHP.  This will be the responsibility of the property owner 
  • connect the system to an uncontrolled heating source 
  • be responsible for any upgrades to your existing consumer unit 
  • be responsible for any costs associated with upgrading the electrical supply to your property further to the DNO application
  • move or remove any of your personal belongings. This includes furniture and soft furnishings.
  • carry out any works that are related to asbestos or dangerous waste (surveying, sampling, testing and removal) whether identified at point of survey or during the installation
  • move or remove any white goods within the property. This includes, but is not limited to, fridges, washing machines, cookers, hobs and dishwashers
  • remove a cold water or feed and expansion tank from the loft space if the hatch is not large enough. In this case the tanks will be drained down and made safe
  • make good existing decorations and wall finishes
  • re-instate solid fuel appliances following the installation of your new heating system
  • be responsible for any loss, damage or liability caused by anyone other than the installation team
  • carry out any remedial work to the building structure such as brick flues, chimneys or fireplace openings
  • power flush where we are installing an entire heating system 
  • carry out any structural building or groundwork due to the installation unless specifically itemised in your quote
  • upgrade the property’s electrical supply to meet current regulations if it is sub-standard or inadequate
  • replace lead piping, faulty cold water stop taps or faulty domestic fittings (i.e taps) when pressurised
  • guarantee that an existing shower will be compatible with the new system

1.      How this Agreement works – our contract with “You” (the customer).

1.1       “We” means We/Us/Our as E.ON Energy Installation Services Limited a company registered in England and Wales. Our company registration number is 09965944 and our registered office and correspondence address is at Westwood Way, Westwood Business Park, Coventry, CV4 8LG.

“BUS” means the Boiler Upgrade Scheme which provides a grant towards the installation of Air Source Heat Pumps (‘ASHP’) for eligible properties under the BUS.

1.2    E.ON Energy Installation Services Limited is authorised and regulated by the Financial Conduct Authority in relation to credit broking services under number 750410 on the Financial Services Register.

“Agreement” means collectively these terms and conditions and Your Quotation.

1.3    This Agreement constitutes the terms under which We supply products to You, whether these are goods or services. Please read these terms carefully before you submit your order to us. These terms tell You how We will provide products or services to You, what to do if there is a problem and other important information. 1.4    Our acceptance of Your order will take place when You accept these terms and conditions. We will confirm receipt at which point a contract will be made between You and Us.

1.5    If We are unable to accept Your order, We will inform You of this in writing. This might be because the product is out of stock, because of unexpected limits on our resources which We could not reasonably plan for, because We have identified an error in the price or description of the product or because We are unable to meet a delivery deadline.

1.6    The Quotation reference number detailed in Our formal Quotation We have provided You with will become Your order number when We have received Your signed terms and conditions.   It will help Us if You can tell Us the order number whenever You contact Us about Your order.

1.7    If We provide You with a new Quotation and You wish to proceed with the services referenced within this new Quotation  You will need to accept the new Quotation as explained in clause 1.6 above.

2.      The Services – what We will and won’t do

2.1    We shall:

(a) provide the goods and services to You in accordance with Your Quotation;

(b) use all reasonable care and skill in the provision of the services detailed within Your Quotation;

(c) ensure that any goods provided in line with Your Quotation shall be suitable for the specified purpose.

2.2    To ensure We are complying with any applicable laws, regulations and/ or safety requirements or where the nature of quality of the goods or services are not significantly affected We may make changes the goods or services. Where we  make changes pursuant to this clause We will notify You of the changes made as soon as possible and prior to the change taking effect.

2.3    We shall after completing the services, tidy up after Ourselves and repair any damage which results directly from the services We have provided.

2.4    We warrant that as from the date of delivery for a period of 24 months that, the installation of goods and services are free from any defects in workmanship, construction or materials. Your ASHP will also come with a manufacturer’s warranty (subject to You registering Your ASHP with the manufacturer). We will advise You of this process at time of installation.  

3.      What We need You to do

3.1    You shall:

(a) allow Us (and any sub-contractors) access to Your property to provide the goods and services;

(b) ensure that the space where the services are to be undertaken is cleared, tidy, easily and safely accessible;

(c) provide Us with access to electricity and water to be able to complete the services;

(d) tell Us straight away if anything has changed in Your property between the date of the initial assessment and when Your ASHP installation is due to start.

(e) comply with any obligations required of You in relation to the services (i.e obtaining consents).

If You do not allow Us or Our subcontractors access to Your property to perform the services as arranged, We may charge You additional costs incurred as a result. If despite Our reasonable efforts, We are unable to contact You or re-arrange access to Your property We may end this Agreement and clause 6.1a will apply.

3.2     You must at all times behave appropriately when Our staff visit Your home. You must not physically or verbally abuse Our staff in any circumstances. Should this happen We may end Your Agreement without refund of any payments.

3.3    Where You wish to apply for a grant under the BUS You must provide Your consent for Us to make the application on Your behalf and share Your details with OFGEM for the purposes of making the BUS grant application. You must also provide Us with any and all information required to allow Us to make the relevant application on Your behalf.

3.4    You shall guarantee that all the information You have supplied to Us is correct, accurate and complete and You will promptly notify Us of any changes. We will be relying on the information You provide to Us to apply for the BUS grant on Your behalf and You are required to notify Your consent to OFGEM within 14 days of OFGEM contacting You. Due to this You shall be responsible for the full cost of Your ASHP installation if You withdraw Your consent for the application to be made, the BUS grant is refused, withdrawn, revoked, delayed or expired due to any incorrect, inaccurate, delayed or incomplete information You have provided to Us, OFGEM or Your failure to notify Us of any changes (including proceeding with a BUS grant application with an alternative installer).  

3.5    Following Your ASHP installation OFGEM may also request access to inspect Your ASHP installation where a grant under the BUS has been made.

3.6    You shall be responsible for ensuring Your ASHP is regularly serviced and maintained by an accredited engineer at least once a year. Your warranty maybe invalidated should You fail to do this.

3.7    We will not be responsible for any costs associated with You failing to complete any of Your responsibilities under this Agreement.

4.      Price

4.1    You shall pay the price for Your ASHP installation as set out in Your Quotation and at the times set out in Your Quotation.

4.2    Where You are using a BUS grant to part fund Your ASHP installation We will need to apply for the BUS grant on Your behalf and We shall redeem the BUS grant voucher following completion of Your ASHP installation. The price set out in Your Quotation will reflect the BUS grant funding being applied.

4.3    In the event that the BUS grant is refused, revoked, withdrawn, the time period for Your ASHP installation to be completed under the BUS has expired or OFGEM require repayment of the BUS  grant (for any reason notwithstanding any finance agreement You may have entered into) if this is due to You not complying with Clauses 3.3, 3.4 and/or Clause 3.5 You will become liable for the full costs of the ASHP installation and  will be required to repay to Us any amounts which had previously been covered by the BUS grant. This applies regardless of any ongoing investigation by OFGEM.    

5.      Payment

5.1    Due to Our different options for payment We will confirm the agreed payment method and terms with You in writing.

Where required under the payment terms agreed with You and as confirmed in writing in accordance with clause 5.1 above, We may need You to make an up-front payment as set out in your Quotation before We can commence Your ASHP installation. Where We have agreed to take an upfront payment from You and collect the remainder of payment upon completion of the services We will need to carry out a credit check.  This credit check will create a record against Your credit file.  If You fail this credit check We would need You to make full payment of the price to Us before We can commence the services.

5.3    On completion of Your ASHP installation We will require full payment of any outstanding balance as set out in Your Quotation. Payment terms are seven days from completion of the ASHP installation.

5.4    If You have applied for finance for the full cost of the goods and installation through Our finance partner, We will not request any upfront payment from You before the installation commences. Where you have applied for finance (either partially or in full) to cover the cost of the goods and installation, You must return a signed satisfaction note to Us upon completion of the installation and in any event no later than 14 days after the date of Your ASHP installation. If You do not return this satisfaction note, Your finance application may no longer be valid or may be cancelled and payment in full within seven days may be requested from You. Once You have returned the signed satisfaction note, We will inform the finance partner and they will pay Us directly. You will need to consult Your credit agreement provider to confirm the nature of the repayment.  If You agree to pay an amount upfront and apply for finance for the remainder, the upfront amount will need to be paid to Us the day your finance is approved.  If for any reason Your finance application is cancelled, for example, by Yourself in the cancellation period under the credit agreement or by the lender, then You will be liable to pay for any services that have been completed. See section 6 for more details about Your cancellation rights under this Agreement.

5.5     Goods and/or products will be Your responsibility from the time We deliver them. You do not own the goods until We have received full payment for the services undertaken.

5.6   If the rate of VAT changes between Your order date and the date We supply the goods and/or product, We will adjust the rate of VAT that You pay.

6.      Ending this Agreement

6.1    We shall be entitled to end or suspend this Agreement by giving You written notice where You don’t:

(a) allow Us access to be able to undertake Your ASHP installation;

(b) provide clear and safe access in line with Clause 3.1(b);

(c) complete Your obligations under this Agreement having been asked by Us and given 21 days’ notice to do so;

(d) complete Your obligations under clause 5 of this Agreement.

In the event this Agreement is terminated You shall allow us access to collect any goods and/or product for which payment has not been made. Should access not be provided We shall be entitled to charge You for these goods and/or products.

6.2    Should Your installation be subject to the BUS  grant We shall be entitled to end this Agreement by giving You written notice where the funding is no longer available, is withdrawn, refused or revoked or the time for completion of the installation has passed due to an occurrence outside of Our reasonable control.

6.3    If You have a bankruptcy petition filed against You or We reasonably believe that You will not be able to pay for the services, We may choose to end or suspend this Agreement until payment in full for the ongoing and completed works has been made.

6.4    You shall have the right to end this Agreement if We fail to materially meet Our obligations under this Agreement.

6.5    You may cancel Your order for services without reason within 14 days following conclusion of this Agreement. If however you request for the services to start prior to the expiration of Your 14 day cooling off period (in accordance with clause 6.8) you shall:

a) if full performance of the services has been completed during Your cooling off period, lose Your right to cancel and bear all costs for services carried out; or

b) if partial performance of the services has been completed during Your cooling off period, pay Us an amount which is in proportion to the services already performed until You have communicated to Us Your cancellation from this Agreement in comparison to the full costs of the services as set out in Your Quotation. Any BUS grant funding may also be impacted and You will be responsible for any associated costs of installation.

6.6    In the event that You cancel the services during Your cooling off period (and have not requested for the services to commence during this period) We will reimburse any payments already made to Us. Refunds will be made within 14 days of You notifying Us of Your right to cancel and will be made by the same means that payment was received from You unless You agree otherwise.

6.7    To exercise Your right to cancel You must inform Us in a clear statement of your decision to cancel the services (“Notice to Cancel”) either by:

completing the cancellation form attached to these terms at Schedule 1 or notifying Us clearly in writing of Your option to cancel and sending this to either:

6.8    Upon receiving a Notice to Cancel from You We will arrange collection of any goods that have been delivered to You in preparation of the services.

6.9    You may request for the services to commence during your 14 day cooling off period under this Agreement by completing and submitting the waiver form contained at Schedule 2.

6.10   If You are a finance customer and have exercised your right to cancel your credit agreement within the 14 day cancellation period afforded under that credit agreement, You will remain liable to Us for the cost of any of the services performed by Us.

7.      Limitation of liability

7.1    Nothing in this Agreement shall limit or exclude Our liability for:

(a)     death or personal injury caused by Our (or our sub-contractors) negligence;

(b)     fraud or fraudulent misrepresentation;

(c)     any other provision which is not permitted to be limited or excluded by law. 

7.2    Our total liability to You in relation to this Agreement shall not exceed £350,000 (three hundred and fifty  thousand pounds. We shall not be liable for whether in contract, tort breach of statutory duty or otherwise any loss of profit or indirect or consequential loss arising under of in connection with this Agreement.

7.3    So far as the law allows the only warranties and/or terms which apply to the goods and services are those set out within this Agreement.

8. Personal data

8.1   Processing your data

9.      Complaints

9.1    If We fail to deliver the standards of service You reasonably expect, We want to know about it so that We can put it right. Email Us at ESUK-Customer-Concerns-E.ON@eon-uk.com or call us or write to us using the contact information above to discuss your query/compliant. We will  assess Your complaint and try to resolve things to Your satisfaction. If We can’t resolve Your complaint, there and then We will carry out a full review and aim to resolve Your complaint within eight weeks.  Please see our website for more details on how we aim to deal with complaints.

9.2 If we haven't resolved Your complaint after eight weeks, or We have sent You a final resolution letter (also known as a deadlock letter) to say there's no more We can do, You can refer Your complaint to the Utilities Alternative Dispute Resolution Service. It's a free and impartial service that sorts out disputes between companies and customers. You can get in touch with them via their website cdrl.org.uk/utilities-adr/

Alternatively, you can refer your case to the Home Insulation & Energy Systems Contractors Scheme (HIES) More information can be found about their dispute resolution service on their website www.hiesscheme.org.uk.

9.3    If Your complaint about our services could cause potential harm to You, Your possessions or members of the public We will escalate the complaint and will visit site to resolve the issue within 24 hours.

9.4    If your complaint relates to our credit broking services (where we have introduced you to a credit lender), You may be able to refer Your complaint to the Financial Ombudsman Service;

We’ll confirm in writing whether You’re eligible to escalate your complaint to an Ombudsman Service.

10.    General provisions

(a) Intellectual Property Rights – aside from intellectual property rights (trademarks, design rights, copyright, know how, business names etc) already owned by third parties all intellectual property rights associated with this Agreement shall be owned by Us.

(b) Survival – Clauses 3, 4, 5, 7, 8 and 9 shall all survive termination of this Agreement.

(c) Entire agreement - This Agreement including the Schedules is the entire Agreement between the Parties. 

(d) Force majeure – Neither You or Us shall be responsible to the other for any failure to perform, delay in performing or imperfect performance of any of its obligations under this Agreement to the extent that this failure, delay or imperfect performance is due to a force majeure event (event or circumstance outside Our or Your reasonable control which cannot be prevented or avoided such as severe weather conditions).

(e) Severance - If any part of this Agreement is found by any court to be invalid, illegal or unenforceable, that part/s shall not to form part of this Agreement. The rest of the Agreement shall not be affected.

(f) Assignment – You shall not assign this Agreement without Our prior written consent. We shall be entitled to assign any of Our rights and benefits under this Agreement to any company within the E.ON SE group of companies.

 (g) Counterparts – this Agreement may be signed in any number of counterparts, but each shall be an original of this Agreement and shall together be the same Agreement.

(h) Third party rights - The Contracts (Rights of Third Parties) Act 1999 shall not apply and no person other than You or Us shall have any rights under it.

(i) Law - This Agreement shall be subject to the laws of England and You and Us submit to the exclusive jurisdiction of the English Courts.

Solar Panels terms and conditions

E.ON Solar Solutions Installation Contract

Terms used in this contract:

Where We use the bold terms below in the Contract, this is what We mean:

"Bespoke Design and Install Service" means the Installation of a Solar Solution which has been designed to produce the Minimum Annual Output specified in Your Quote, carried out using Our mid-range hardware package.

"Cancellation Form" means the form set out in Schedule 1 of the Terms and Conditions attached to your quote.

"Credit Check" means a check carried out by Us to ensure that You have the financial means necessary to cover any payments due under the Contract.

"Contract" means these terms and conditions and the Quote between You and Us for the Installation of Your Solar Solution as may be updated by Us from time to time.

"Cooling off period" means the 14-day period after signing your quote in which you can cancel your contract at no cost to you. We will not book an installation or order any equipment for you within this period, unless you choose to tell us to proceed by completing and sending us the Waiver Form.

"Deposit" means the deposit amount set out in Your Quote.

"Energy Performance Certificate" or "EPC" means, in relation to Your Premises, the certificate setting out the energy efficiency of Your Premises.

"Final Balance Payment" means the amount set out in Your Quote that You must pay Us once the Installation is complete representing the difference between (i) the Price and (ii) the Deposit.

"Force Majeure Event" means an event or circumstance out of Our or Your reasonable control which cannot be prevented or avoided such as fire or severe weather conditions and which stops duties under the Contract from being carried out.

"G99 certificate" means the certificate which may need to be applied for and given by the operator of the local electricity distribution network to which Your Premises are connected to confirm there is network availability for the connection of Your Solar Solution.

"Hazard" the potential that a situation, material or tool which has to cause harm or damage.

"HIES" means the Home Insulation and Energy Systems Quality Assured Contractors Scheme (a DIVision of the Integrity Foundation (Reg. No. 07972075).

"Installation" means the work to design, construct, install, test and commission the Solar Solution at Your Premises, including setting up and dismantling of any scaffolding.

"Instalment Payment Plan" means the agreed instalment payment plan detailing agreed instalment amounts and payment structure set out in the Quote.

"Marketing Materials" means any brochures, drawings, illustrations, literature, samples or other such marketing materials provided in relation to Us or any services or products offered by Us.

"MCS" means the Microgeneration Certification Scheme, accredited under EN45011, and a recognised quality assurance scheme to certify microgeneration products and installers used to produce electricity and heat from renewable sources.

"Premises" means Your domestic premises, the address of which is set out in Your Quote.

"Premium Bespoke Design and Install Service" means the Installation of a Solar Solution which has been designed to produce the Minimum Annual Output specified in Your Quote, carried out using Our premium-range hardware package.

"Price" means the amount set out in Your Quote which You must pay Us for Your Solar Solution and for performing Our obligations under the Contract.

"Quote" means the document which sets out the proposed Solar Solution to be installed at Your Premises which was sent to You as part of the Quote pack.

"Risk" the likelihood or probability of a Hazard causing harm or damage to a person, materials or property.

"Solar Solution" means the solar panels, electricity storage solution and all associated plant and equipment which We propose to install at Your Premises, and described in more detail in Your Quote.

"Solar Inverter" is the electrical equipment which changes direct current (DC) produced by the solar panels into alternating current (AC), making it suitable for use with home appliances and the electricity network.

"Upfront Payment" means the upfront payment amount set out in Your quote.

"Waiver Form" means a form which We will send You on request that You must complete to waive the cooling off period for the Contract.

"We" / "Us" / "Our" / "Ours" means E.ON Energy Installation Services Limited a company registered in England and Wales. Our company registration number is 09965944 and our registered office is at E.ON Installation Services Limited, Westwood House, Westwood Way, Coventry, CV4 8LG. E.ON Energy Installation Services Limited is authorised and regulated by the Financial Conduct Authority in relation to credit broking services under number 750410 on the Financial Services Register.

"You" / "Your" means the person or people who have entered into this Contract with Us.

Terms and Conditions of this Contract

  1. How this Contract Works

    1. The Contract is between You and Us. It is made up of (i) Your Quote and (ii) this Contract (including the schedules). It is important for You to read this Contract carefully so that You understand how it works.
       

    2. If You do not understand this Contract and want to talk to Us about it, or if You would like this Contract in another format (for example: audio, large print, braille), please contact Our Solar Solution and Battery Support Team by email at SolarCustomerSupport@eonenergy.com or by telephone on 0345 366 5981.

    3. If the Contract names more than one person, you'll all be responsible - as individuals and together - for Your obligations under the Contract.

    4. The Contract will start from the date We receive Your signed and dated Quote.

    5. If this Contract contradicts Your Quote, this Contract will take priority.

  2. Your Right to Cancel the Contract

    1. You may cancel the Contract within 14 days from the start date of Your Contract if you change Your mind (the Cooling off period). To exercise this right to cancel, You must tell Us within the Cooling off period in writing, by e-mail or by sending a completed Cancellation Form. You can find Our contact details in the "Contacting Us" section below.

    2. If You decide that You want Us to begin the Installation before the end of the Cooling off periodYou must tell Us by completing and sending Us a Waiver FormWe can send You a Waiver Form on request.

    3. If You send Us a completed Waiver Form and then later decide to cancel the Contract within the Cooling off periodYou can do so (see Section 2.1 above for details). In this situation:

      1. If We have not begun the Installation before You tell Us You want to cancel the ContractWe will reimburse You for any payments that You have already made to Us. Refunds will be made within 14 days of You telling Us You want to cancel and will be made by the same means that payment was received from You unless You and We agree otherwise.

      2. If We have begun the Installation before You tell Us You want to cancel the Contract, but We have not completed the InstallationWe will remove all parts of the Solar Solution that were installed at the time of cancellation and You must pay Us for the costs We have incurred, including the costs of removal and any reduction in the value of the Solar Solution.

      3. If We have completed the Installation before You tell Us You want to cancel the ContractYou will lose the right to cancel the Contract and it will continue in effect.

  3. About Us

    1. We are accredited under and are members of the HIES. When We are performing Our obligations under the ContractWe will make sure that at all times, We comply with the requirements of the HIES.

    2. We may transfer Our rights and/or obligations under the Contract to another company. If We organize for another company to perform some of Our obligations for Us, this will not affect Our responsibility to You under the Contract.

  4. What We need You to do before We install Your Solar Solution

    1. Before We carry out the InstallationYou must satisfy the following conditions (unless We tell You otherwise) (the "installation requirements"):

      1. The Cooling off period period has ended and You haven't cancelled the Contract or You have sent Us a completed Waiver Form (and We have received it).

      2. You have either:

        (a) paid Us in full (and any additional costs specified in Your Quote (and We have received);
        (b) paid Us the Deposit and any additional costs specified in Your Quote (and We have received it;
        (c) made Us aware or We have been made aware that Your application for finance has been accepted and Your loan agreement has been signed.

      3. You have a broadband connection at Your Premises to which We can connect Your Solar Solution to enable communications with the Solar Solution.

      4. You have completed any actions that We have specified in the Quote that You must carry out.

      5. Where any consent or certification is required from Your local distribution network operator for the Solar Solution to be connected to the local distribution network (We will confirm if this is applicable to You), all such consent and certification must be obtained. In order to do this, We will liaise with the local distribution network operator on Your behalf provided that You give Us authority to do so by signing and returning a letter of authority which We will provide to You.

      6. As Your Quote is based on the surveys of Your Premises (desktop and/or physical) which We carried out prior to You entering into the Contract with UsYou must not have carried out any renovation, modification or other alteration to the structure of Your Premises or changed its primary use since the date of Our last survey.

    2. If some or all of the installation requirements are not satisfied within 30 days of the start date of Your Contract and We have not told You that You do not need to satisfy them, We may cancel the Contract or provide You with a new Quote (which, if You accept, will replace the existing Quote).

    3. You must also obtain all consents and permissions by the date on which We complete the Installation to allow Us to carry out the Installation and to keep Your Solar Solution installed at Your Premises. These consents and permissions may include building regulation completion certificates, planning permissions, landlord consents and mortgagor consents. If We ask YouYou must promptly provide Us with proof that You have obtained them. If You have not obtained them all, We may cancel the Contract or provide You with a new Quote (which, if You accept, will replace the existing Quote).

    4. We may determine that a structural survey of Your property is required to confirm that Your roof structure is suitable for the solar solution installation. If We request a structural survey from You, it is Your responsibility to provide this to Us before We can proceed with the installation. We may cancel the Contract or provide You with a new Quote (which, if You accept, will replace the existing Quote).

  5. Arranging a date for the Installation

    1. Once We have received and reviewed the survey of Your house from Your sales consultant Our Delivery Team will contact You to arrange a date on which We can begin the Installation (the "installation date").

    2. If You want to re-arrange the installation date, You must give Us at least 24 hours' notice. If You give Us less than 24 hours' notice, You must pay Us the costs We have incurred as a result. If You re-arrange the installation date two times or more, We may cancel the Contract.

    3. We may re-arrange the installation date if We believe that, on the day, the weather or the occurrence of an event or circumstances at or near Your Premises (and which is outside Our reasonable control) means that We cannot carry out the Installation safely. We will try to give You as much advance notice as possible.

  6. Installing Your Solar Solution

    1. Your Quote will set out how long We think it will take to carry out the Installation at Your Premises. Although every case is different, the Installation of a Solar Solution will, typically, take between one and three days, although We may need to return to Your Premises on a subsequent day in order to complete the final tests of the Solar SolutionWe may also need to attend Your Premises before and after the Installation in order to set up and dismantle any scaffolding which is required.

    2. If Your system is being installed under a G99 certificate, in some circumstances Your Solar Solution may have to be locked off and not used until the local distribution network operator in Your local area has received a copy of the commissioning certificates. Our Technical Team will discuss this with You and manage this prior to the Installation if this is applicable to Your Installation.

    3. Hazards during the installation and protection against these

      1. During the Installation there will be hazards such as tools and materials, cables, dust sheets, ladders and scaffolding at Your PremisesWe want to keep You, Your family, visitors and Our people as safe as possible so please try to avoid the work areas and take care when entering is required. Please also ensure You follow any instructions the technicians/contractors give you at all times. By signing these terms and conditions You confirm that You understand and are aware of what You need to do regarding the hazards associated with the Installation. 
    4. What We need You to do during the Installation

      1. In order for Us to carry out the InstallationYou agree to give Us (and Our representatives and sub-contractors) safe, full, free and unrestricted access to Your Premises including access to electricity, broadband, earthing and other relevant services at Your Premises that We need to carry out the Installation.

      2. If We ask, You must empty and otherwise make ready, airing cupboards, storage and other parts of Your Premises to enable the Installation.

    5. During the Installation:

      1. You, or a responsible person who is over 18 years old and authorized by You, must be at the Premises at all times (unless We agree with You otherwise).

      2. You must take reasonable steps to ensure the health and safety of Our personnel, contractors and sub-contractors whilst they are working at the Premises.

    6. If You do not comply with Your responsibilities set out in Sections 6.3 and 6.5 above for a period of seven days after We have told You about Your non-compliance, We may cancel the Contract.

    7. If We discover an environmental issue or condition at the Premises (such as the existence of asbestos), We will tell You immediately and stop the InstallationYou will be responsible for rectifying the issue or condition. Once rectified, We will continue with the Installation. If You do not rectify the issue or condition within three months of Us telling YouWe may cancel the Contract or provide You with a new Quote (which, if You accept, will replace the existing Quote).

    8. You will be responsible for any parts and materials that are delivered to the Premises. If We leave any tools or equipment with You (with Your agreement) and You damage, tamper or lose them (or fail to prevent their damage or loss), We may charge You for Our costs in repairing and/or replacing them.

    9. Our responsibilities during the Installation

      1. We will observe all health and safety regulations.

      2. We will use reasonable care and skill.

      3. We will:

        (a) take reasonable care to avoid disrupting Your Premises;
        (b) remove all waste material relating to the work We have carried out; and
        (c) clean up to a reasonable standard, but We will not repaint or redecorate any surfaces affected by Our work and We will not accept responsibility for damage to carpets or other floor coverings, unless We have been negligent.

      4. We will use materials that are of satisfactory quality.

      5. We will ensure that Your Solar Solution complies with all regulations and standards current at the time.

    10. We will use Our reasonable efforts to ensure that the plant and equipment that We install at Your Premises as part of Your Solar Solution corresponds with the plant and equipment set out in Your Quote. However, We cannot guarantee that the plant and equipment will be available when carrying out the Installation. If any plant and equipment is unavailable, We will install substitute plant and equipment which is of a similar or better specification to the unavailable plant and equipment.

    11. If, during the InstallationWe find that additional work is required or additional costs will need to be incurred (which has not been caused by Our neglect or default) or if You change the requirements of the Solar Solution from what is set out in Your QuoteWe will provide You with a new Quote (which, if You accept, will replace the existing Quote). If You do not accept the new QuoteWe may cancel the Contract. An example of additional costs that may be incurred is if Your Solar Solution needs a G99 certificate and the local electricity distribution network decides to impose certain charges for issuing the G99 certificate.

  7. Completion of the Installation

    1. We will let You know once the Installation is complete. Once the Installation has been completed:

      1. You must if You have opted to pay an initial deposit prior to installation pay Us the Final Balance Payment within seven days of the date on which the Installation was completed.

      2. If You do not pay the Final Balance Payment within 30 days after having received a reminder from UsWe may cancel the Contract. Please also see the "If You don't pay" section below about other remedies We may have.

  8. Paying for Your Installation

    1. We have a number of different payment options and will confirm the agreed payment method and terms with You in writing. Please see below for the relevant section depending on how You have paid for Your Installation.

    2. Where You have paid a Deposit:

      1. Where We have agreed to take a Deposit from You and collect the remainder of payment upon completion of the Solar Solution and Installation services, We will need to carry out a credit check. This credit check will create a record against Your credit file. If You fail this credit check We would need You to make full payment of the Price to Us before We can commence the Services.
    3. Where You have applied for finance:

      1. If You have applied for finance for the full cost of the Solar Solution and Installation through Our finance partner, We will not request any upfront payment from You before the Installation begins. Once You have agreed that the Installation has been completed by completing a satisfaction note and returning it to UsWe will inform Our finance partner and they will pay Us directly. You will need to consult Your credit agreement with them to confirm the nature of the repayment. If for any reason Your finance application is cancelled, for example, by Yourself in the cancellation period under the credit agreement or by the lender, then You will be liable to pay Us for the Installation that has been completed.
    4. The Solar Solution (and associated products) will be Your responsibility from the time We deliver them. You do not own the Solar Solution until We have received full payment for the services undertaken.

    5. On completion of the Installation of the Solar Solution We will require full payment of any outstanding balance as set out in Our Quote. Payment terms are seven days from completion of the Installation.

    6. Once We have received the Final Balance Payment from You:

      (a) You will become owners of and responsible for Your Solar Solution; and
      (b) We will apply to certify Your Solar Solution under the MCS or equivalent registration body, and will provide You with the certificate once We receive it.
      (c) You will benefit from the guarantees and warranties for the parts of Your Solar Solution as specified in Your Quote. These guarantees and warranties will be for Your benefit and all subsequent owners of Your Premises and will be valid for the period set out in each guarantee and warranty. These guarantees and warranties have their own terms and conditions and We recommend that You read them carefully to understand Your rights and obligations under them. If You do not understand and want to talk to Us about these, please contact Our Solar Solution and Battery Support Team by email at SolarCustomerSupport@eonenergy.com or by telephone on 0345 366 5981. Other than these warranties, all other warranties (including fitness for purpose) are implied by law or otherwise are excluded to the fullest extent permitted by law.

  9. Other Provisions

    1. Our standard workmanship guarantee is 2 years from the date of completion of Installation of Your system. This covers defects associated with the Installation We carried out, but not product defects, which are covered by manufacturers' guarantees and warranties (see below).

    2. We will provide You with (or arrange the provision to You of):

      (a) copies of the product guarantees and warranties which You benefit from;
      (b) copies of all certificates, user manuals, guides, instructions, drawings and other documentation relating to Your Solar Solution.

    3. In rare circumstances, Your local distribution network operator may need to carry out works in Your local area and may require You to disconnect Your Solar Solution until these works have been completed. Please note that We will not be legally responsible to You for any losses that You may incur in these circumstances.

  10. Your Ongoing Rights and Obligations

    1. Once the Installation has been completed:

      (a) You agree to comply with all conditions of the consents and permissions to keep Your Solar Solution installed at Your PremisesYou must tell Us immediately if You become aware that You have not complied with these conditions.
      (b) You must maintain a broadband connection at Your Premises and keep Your Solar Solution connected to it to enable communications with the Solar Solution.
      (c) You must allow UsOur personnel, contractors and sub-contractors to access Your Premises at reasonable times where We ask You in order to inspect Your Solar Solution, to carry out any of Our responsibilities or exercise any of Our rights under the Contract.

  11. Force Majeure

    1. Neither You nor We will be legally responsible to the other for any failure or delay to perform its obligations under this Contract if such a failure or delay is due to a Force Majeure Event.

    2. If the Force Majeure Event affects Yours or Our ability to carry out its obligations under the Contract for a continuous period of 3 months then the non‑affected person may cancel the Contract.

    3. If the Contract has been cancelled for a Force Majeure Event and (i) You have not paid the Final Balance Payment and (ii) You are not paying the Final Balance Payment in accordance with Section 7.1.2 (via an agreed Instalment Payment Plan), We will remove the Solar Solution from Your Premises and return Your Premises to a reasonable standard at no cost to You.

  12. Limits on Our Responsibility to You

    1. Nothing in the Contract removes or limits Our legal responsibility to You for death or personal injury caused by Our negligence. We also accept full legal responsibility if We act in a fraudulent way. This Contract does not affect any rights You have by law.

    2. Except for Our legal responsibility for death or personal injury, as set out above, We are not legally responsible under this Contract for:

      1. any losses that are not Our fault, or that We could not have reasonably expected when We entered into this Contract; or

      2. any financial losses (for example, wasted expenses or loss of profit, income, opportunity, contract or goodwill).

    3. If We are legally responsible to You for any loss or damage Our legal responsibility to You will be limited to £100,000 for all incidents that lead to loss or damage.

  13. Ending Your Contract

    1. Expiry of the Contract - this Contract will automatically end on completion of the Installation, unless it has been cancelled earlier by either You or Us in accordance with the Contract.

    2. Cancellation by You

      1. In addition to the rights You have to cancel the Contract as set out elsewhere in these Terms and ConditionsYou can cancel the Contract if You are moving home. You must tell Us when You are going to move out of Your home so We can ensure Your Solar Solution will work for the next occupant. The cancellation will take effect on the date You move home. To do this, please contact Our Solar Solution and Battery Support Team by email at SolarCustomerSupport@eonenergy.com or by telephone on 0345 366 5981. We will acknowledge all cancellations in writing or by e-mail.
    3. Cancellation by Us

      1. In addition to the rights We have to cancel the Contract as set out elsewhere in these Terms and ConditionsWe may also immediately cancel the Contract if We are unable to complete the Installation:

      2. for any reason (e.g. health and safety, structural or technical reasons connected with Your Premises) which has not been caused by Our neglect or default and which You have not resolved the issue within 30 days of Us telling You about it; or

      3. for the occurrence of an event or circumstance which prevents completion of the Installation which could not have been reasonably foreseen by Us and which You have not resolved the issue within 30 days of Us telling You about it.

    4. Cancellation by You or Us

      1. In addition to the right to cancel the Contract if a Force Majeure Event occurs (see Section 10 for more details), either You or Us (as the person cancelling) may cancel the Contract immediately, if (i) the non-compliant person has been informed about its non-compliance and (ii) after being informed, continues to not comply for a period of 30 days.
    5. Consequences of expiry or cancellation:

      1. If You have cancelled the Contract because We have varied the Contract or as a result of any neglect or default by Us, then If (i) You have not paid the Final Balance PaymentWe will remove the Solar Solution from Your Premises and return Your Premises to a reasonable standard at no cost to You If (ii) the final balance has been paid upfront, we will We will remove the Solar Solution from Your Premises and return Your Premises to a reasonable standard at no cost to You and refund Your Payment.

      2. If You have taken out finance for Your Solar Solution and have exercised Your right to cancel Your credit agreement within the 14 day cancellation period afforded under that credit agreement, You will remain liable to Us for the cost of Your Solar Solution and any associated installation.

      3. If We have cancelled the Contract as a result of anything You have done or not done (including not passing a Credit Check), then:

      4. If You have not paid the Final Balance Payment, and You are not paying the Final Balance Payment in accordance with Section 7.1.2 (via an agreed Instalment Payment Plan), We will remove the Solar Solution from Your Premises and return Your Premises to a reasonable standard.

      5. We may charge You for the costs We have incurred up until the cancellation of the Contract (as well as costs for removing the Solar Solution and returning Your Premises to a reasonable standard). Where We do charge You for Our costs, We are entitled to recover what You owe Us either (i) by retaining an amount of Your Deposit equal to Our costs or (ii) invoicing You for the amount owed. We will return the outstanding balance of Your Deposit to You within 30 days.

      6. If You have a bankruptcy petition filed against You or We reasonably believe that You will not be able to pay for the Installation of Your Solar SolutionWe may choose to end or suspend this Agreement until payment in full for the completed and ongoing Installation has been made.

      7. Ending Your Contract will not affect any guarantees and warranties provided in relation to Your Solar Solution, any rights and responsibilities that You or We had before the Contract ended, or which are due to come into force under the Contract or to continue after the date it ended.

  14. Advice and Complaints

    1. If We fail to deliver the standard of service You expect, You can contact Our Solar Solution and Battery Support Team so that We can put it right. You can find their contact details in the "Contacting Us" section below.

    2. We train Our Solar Solution and Battery Support Team to be able to sort most things out straight away. If they can't, Our resolution team will take over. We try to resolve complaints in two working days or less. If You're not satisfied with how We respond, You can ask Us to review Your case. We'll look into how We've handled it and decide if We should do anything differently.

    3. If We haven't resolved Your complaint after eight weeks, or if We have sent You a final resolution letter, also known as a deadlock letter, to say there's no more We can do, You can go to the Retail Ombudsman. It's a free and impartial service that sorts out disputes between companies and customers. You can get in touch with the Retail Ombudsman by telephone on: 0203 598 7390 or by email at: enquiries@ombadr.org. What they decide is legally binding for Us, but not for You.

    4. Alternatively, You can refer Your case to Our nominated alternative dispute resolution provider through the HIES. Under the HIES, the nominated provider is The Ombudsman Service Limited (registered company number 04351294) and You can contact them via HIES at:

  15. Your Personal Data

    1. Processing Your data

      1. If You provide any personal data to Us under this Contract E.ON Energy Installation Services Limited will be the 'data controller'. Our Data Protection Office can be contacted at Newstead Court, Little Oak Drive, Annesley, Nottinghamshire, NG15 0DR. We will process Your personal data in accordance with Our privacy notice, as amended from time to time, which can be found at eonenergy.com/privacy or by contacting Us to request a paper copy. Our privacy notice sets out:

        • Where We might get data about You from;
        • Why We need it;
        • What We might do with the data (including who We might share it with);
        • The circumstances in which Your data might be transferred abroad; and
        • How long We keep it for.
    2. Your rights

      1. You have a number of rights relating to the access to, and control of Your data. These are also set out in Our privacy notice.

      2. In addition to the information within the privacy notice We will also need to transfer data to the provider of Your solar inverter(s) for the purposes of providing You with access to generation and/or consumption visualization platforms such as E.ON Home or those provided by inverter manufacturers.

      3. If You have an inverter manufactured by SolarEdge the visualization platform is hosted within the EU and We provide the following information during registration:

        • Your customer reference number (for example: "L123456"),
        • The date Your Solar Solution was commissioned,
        • The serial number of Your inverter(s), and
        • The manufacturer, model, inclination and orientation, and number of solar panels You have fitted.
      4. If You have an inverter manufactured by Solis, the visualization platform is hosted in China and We provide the following information during registration:

        • Your Customer reference number (for example: "L123456"),
        • Your email address to send You a registration link,
        • The rated output of Your Solar Solution, and
        • The serial number of the communications interface ("dongle") attached to Your inverter(s).
      5. If You have an inverter manufactured by GivEnergy, the visualization platform is hosted in Germany and We provide the following information during registration:

        • Your Customer reference number (for example: "L123456"),
        • Your name and email address to send You a registration link,
        • Your town/city and postcode region, and
        • The approximate location of Your property, set on a map (we will centre on Your town or street, rather than Your actual property location), and
        • The serial number of the communications interface ("dongle") attached to Your inverter(s).
      6. If We also offer You access to the E.ON Home visualization platform, the platform is hosted in Germany, and We provide the following information during registration:

        • Your name and email address,
        • Your Customer reference number (for example: "L123456"),
        • The rated output of Your Solar Solution, and
        • The serial number of Your inverter(s), and/or the communications interface ("dongle") attached to Your inverter.
      7. After Your account has been set up on the relevant inverter manufacturer's visualization platform or E.ON Home, generation and/or consumption data is transferred from Your inverter to the platform to allow You to view this information.

      8. If You do not wish for Your data to be shared in this way We can stop the transfer of information; however, this will require the deletion of Your account within the inverter manufacturer's visualization platform or E.ON Home, so You will no longer be able to view Your generation and/or consumption information.

  16. If You don't pay

    1. If You owe Us a balance after installation, You agree to make all payments You owe Us promptly and without any deductions whatsoever. If You do not pay promptly and in full when amounts owed to Us are due, or where We have reminded You that amounts are overdue, We may take reasonable action to recover any amounts owed, together with any costs We incur in dealing with an overdue payment. We may appoint a debt collection agency and/or take legal action if You do not pay (e.g. the Final Balance Payment).
  17. How We'll contact You

    1. If You have given Us an email address or mobile telephone number We may email or text You to manage Your account or to provide You with useful information. We may also send You messages by social media if You have provided Us with these details.

    2. If You change Your email address, social media account or mobile phone number You will need to let Us know straight away to make sure You still receive messages from Us.

  19. General

    1. We reserve the right to change the terms of the Contract. If We do, We will notify You about the changes and when they will take effect. If You do not agree with the changes, You can cancel the Contract with immediate effect by telling Us by e-mail or in writing by post within 7 days of receiving Our notification. You can find Our contact details in the "Contacting Us" section.
       

    2. By agreeing the ContractYou agree to Us to carrying out a Credit Check on YouWe will carry out this check before You have paid Us the Deposit. If for any reason You fail the Credit Check We reserve the right to immediately cancel the Contract.
       

    3. If any court, ombudsman or any other competent authority decides that any aspect of a provision of the Contract is invalid or unenforceable, that aspect of that provision shall be severed from the Contract and shall have no effect on the remainder of the Contract.
       

    4. The Contract is governed by the laws of England and Wales. Your statutory rights as a consumer are set out in legislation and nothing in the Contract, or any of Our Marketing Materials shall affect any of Your or Our statutory rights.
       

Schedule 1 - Cancellation Form

Schedule 3 - Additional Terms and Conditions for Add-On Products

Bird Deterrent

  1. Bird Deterrent” means the product supplied to deter birds from getting underneath Your solar panels fitted by Us as part of the Installation.
  2. Bird Deterrent products lower the chances of pests getting underneath Your solar panels. We do not guarantee that the Bird Deterrent will prevent birds from getting underneath Your solar panels.
  3. You must not interfere with or attempt to remove the Bird Deterrent. We will not be liable for any damage caused to Your Installation if You attempt to do this.
  4. If You believe that the Bird Deterrent is faulty and it is within the manufacturer guarantee period as stated in Your Quotation then You must contact the manufacturer directly.
  5. If You believe that the Bird Deterrent has failed due to an issue with Our workmanship and it is within the 24-month period of Our workmanship warranty, then please contact Us using the details in Your Quotation.

Boiler installation terms and conditions

1.      Agreement

The “Agreement” means collectively these Terms & Conditions and Your Quotation. The Agreement is a legally binding contract between Yourself and E.ON Energy Installation Services Limited (“E.ON”).

2.      Installation

We will use all reasonable care and skill when installing goods at Your property (the “Installation”) and ensure that any goods are suitable for the specified purpose in line with Your Quotation and manufacturer’s guidelines.

 

3.      Price

You will pay the price as set out in Your Quotation. If You decide to pay via a credit agreement, E.ON is authorised and regulated by the Financial Conduct Authority in relation to credit broking services (full details can be found in these Terms & Conditions).

 

4.      Your right to cancel

You have a 14-day cooling off period if You wish to cancel this Agreement. If you would like to cancel, please get in touch either by phone on 0800 054 6250, or by notifying Us in writing and sending this to either (a) E.ON Energy Installation Services Limited, Westwood Way, Westwood Business Park, Coventry, CV4 8LG or (b) Salesteam@eonenergy.com. You may use the cancellation form provided in Schedule 1 if you wish.

 

5.      Processing your data

If You provide any personal data to Us under this Agreement, E.ON will be the “data controller”. Our Data Protection Officer can be contacted at Westwood Way, Westwood Business Park, Coventry, CV4 8LG.

We will process Your personal data in accordance with Our privacy notice, as amended from time to time, which can be found at www.eonenergy.com/privacy or by contacting Us to request a paper copy. Our privacy notice sets out:

·        where We may get data about You from;

·        why We need it;

·        what We may do with the data (including who we may share it with);

·        the circumstances in which Your data might be transferred abroad; and

·        how long We keep it for.

 

6.      Standard of service

If We don’t deliver the standard of service You reasonably expect, We want to know about it so We can try and put it right. Email or call Us on the details in paragraph 4 above to discuss Your complaint. We’ll then assess Your complaint and try to resolve things to Your satisfaction. If We can’t resolve Your complaint there and then, We’ll carry out a full review and respond to You within eight weeks.

 

7.      Key inclusions – We will

·        Provide suitably skilled and experienced staff;

·        Ensure goods provided for Your Installation are suitable for their specified purpose;

·        Clean up the respective work area after the Installation.

 

8.      Key exclusions – We will not

·        Work in any area that we deem unsuitable;

·        Carry out work that we deem unsuitable;

·        Remove any of Your personal belongings including furniture and soft furnishings.

 

 

What is included in Your Installation

We will (as necessary):

P

Alter the hot and cold-water service pipework for the introduction of the new boiler.

P

Test the suitability of the wall for the boiler location.

P

Fit the new boiler and flue as per the manufacturer’s instructions. This includes the installation of any support brackets.

P

Use the existing fused spur outlet and provide a new 3-amp fuse and wiring from the spur to the boiler if required. An adequate electrical supply to property is assumed.

P

Use trunking to encase the cable from the spur to the bottom of the boiler casing and connect the electrical supply to the boiler as per the manufacturer’s instructions.

P

Terminate condensate pipework at the waste point as per the manufacturer’s instructions.

P

Install pressure relief valve pipework as per manufacturer’s instructions (if required).

P

Test equipotential earth bonding.

P

Securely clip all new pipework.

P

Carry out all commissioning checks as per the specification and any manufacturer’s instructions.

P

Provide a completed handover pack. This will include the manufacturer’s instructions, relevant electrical works certificate, gas certificate, building notification and guarantee.

P

We will register the manufacturer’s warranty and provide a 12-month workmanship guarantee.

P

Fit a programmer and/or thermostat/programmable room stat in an appropriate location as detailed in Your Quotation.

P

Fit a terminal guard to the boiler flue, as detailed in the manufacturer’s instructions (where applicable).

P

In the case of a back boiler to combination boiler change we will isolate water, electrical and gas supplies as necessary to ensure the safe and careful drain down and removal of the existing gas back boiler unit. If removal of the back boiler is not possible it will be decommissioned and left in situ. A radiator will be fitted if the room containing the back boiler has no other heat source. We’ll make good to the opening following the removal of back boiler unit but not the final finish.

P

Alter the hot and cold-water service pipework for the introduction of the new boiler.

P

We will upgrade Your pipe insulation to meet the relevant building regulations standard.

 

 

What is not included in your installation (unless specified in Your Quotation)

We will not:

O

Move or remove any of Your personal belongings. This includes furniture and soft furnishings.

O

Carry out any works that are related to asbestos (until tested and proved safe or removed) whether identified at point of survey or during the Installation.

O

Move or remove any white goods within the property. This includes, but is not limited to, fridges, washing machines, cookers, hobs and dishwashers.

O

Replace any type of domestic hot water cylinders.

O

Remove a cold water or feed and expansion tank from the loft space if the hatch is not large enough. In this case the tanks will be drained down and made safe.

O

Carry out work to existing radiators, valves or associated pipework. This includes, but is not limited to, tap washers and toilet cisterns.

O

Make good existing decorations and wall finishes. This includes unpreventable damage to the chimney if removing a back boiler.

O

Re-instate solid fuel appliances following the installation of new boiler.

O

Be responsible for any loss, damage or liability caused by anyone other than Our installation team.

O

Carry out any remedial work to the building structure such as brick flues, chimneys or fireplace openings.

O

Power flush the existing heating system.

O

Carry out any structural, building or groundwork due to the installation.

O

Gain planning permission for flues on listed buildings or managed properties. This is the responsibility of the property owner.

O

Upgrade the property’s electrical supply to meet current regulations if it is sub-standard or inadequate.

O

Fit an earth rod.

O

Replace lead piping, faulty cold water stop taps or faulty domestic fittings (i.e. taps) when pressurised.

O

Provide gas pipework runs or cold-water pipework runs.

O

Guarantee that an existing shower will be compatible with the new system.

O

Fit a condense pump or soak away.

O

Provide a plume management kit.

O

Upgrade the existing system to Y-plan (wired or radio frequency) or S-plan (wired or radio frequency).

 

 

 

1.         How this Agreement works – our contract with “You” (the customer).

 

1.1    E.ON Energy Installation Services Limited is authorised and regulated by the Financial Conduct Authority in relation to credit broking services under number 750410 on the Financial Services Register.

 

1.2      “We” means We/Us/Our as E.ON Energy Installation Services Limited, a company registered in England and Wales. Our company registration number is 09965944 and our registered office and correspondence address is Westwood Way, Westwood Business Park, Coventry, CV4 8LG.

 

1.3    “Agreement” means collectively these terms and conditions and Your Quotation.

 

1.4    "Final Balance Payment" means the amount set out in Your Quotation that You must pay Us once the Installation is complete representing the difference between (i) the price and (ii) the upfront payment.

 

1.5    “Installation” means the works and goods set out in Your Quotation.

 

1.6    “Quotation” means the quote for goods and services sent from Us to You.

 

1.7    This Agreement constitutes the terms under which We will carry out the Installation for You. Please read these terms carefully before You accept Your Quotation. If You have any queries about this Agreement please contact Us on 0800 054 6250, or email Us at   Salesteam@eonenergy.com.

 

1.8    When You accept Your Quotation a contract will be made between You and Us.

 

1.9    If We are unable to accept Your Quotation, We will inform You of this in writing. This might be because a product is out of stock, because of unexpected limits on our resources which We could not reasonably plan for, because We have identified an error in the price or description of a product or because We are unable to meet a delivery deadline.

 

1.10 The Quotation reference number detailed in Your Quotation will become Your order number. It will help Us if You can tell Us this number whenever You contact Us about Your Installation.

 

1.11 If We provide You with a new Quotation and You wish to proceed with the Installation referenced within this new Quotation You will need to accept the new Quotation before we can carry out Your Installation.

 

2        The Installation – what We will and won’t do

 

2.1    In accordance with Your Quotation, We shall:

 

(a)     provide goods and services to You;

(b)     use all reasonable care and skill in the provision of the Installation;

(c)     ensure that any goods provided shall be suitable for the specified purpose;

(d)     carry out the Installation by an agreed timescale; and

(e)     tidy up and repair any damage caused by Us which results directly from the Installation.

 

2.2    To ensure We are complying with any applicable laws, regulations and/ or safety requirements or where the nature of quality of the goods or Installation are not significantly affected, We may make changes the goods or Installation. Where We make changes pursuant to this clause, We will notify You of the changes made as soon as possible and prior to the change taking effect.

 

2.3    We warrant that for a period 12 months from the date of Installation Our Installation workmanship will be free from defects. You will be advised in Your Quotation whether any goods supplied as part of Your Installation come with their own manufacturer’s warranty, and if so We will register this on Your behalf and provide You with the documentation.  

 

2.4    Nothing in this Agreement affects Your legal rights under the Consumer Rights Act 2015 (also known as Your statutory rights).  You may also have other rights in law.

 

3        What We need You to do

 

3.1    You shall:

(a)     allow Us (and any sub-contractors) access to Your property to carry out Your Installation;

(b)     ensure that the space where the Installation will be undertaken is cleared, tidy, easily and safely accessible;

(c)     provide Us with access to electricity and water;

(d)     tell Us straight away if anything has changed in Your property between the date of the initial assessment and when the Installation is due to start; and

(e)     comply with any obligations required of You in relation to the Installation (e.g. obtaining consents).

 

3.2    If You do not allow Us or Our subcontractors access to Your property to perform the Installation as arranged, for whatever reason, We may charge You our additional costs incurred as a result. If despite Our reasonable efforts We are unable to contact You or re-arrange access to Your property to undertake the Installation We may end this Agreement and reserving Our rights as to additional costs We will reimburse any payments You have already made to Us.

 

3.3    You must at all times behave appropriately to Us and not physically or verbally abuse Our staff in any circumstances. This includes over the phone and when We or Our sub-contractors visit Your home. Should this happen, We may refuse to carry out or continue with the Installation and end Your Agreement, should this occur We reserve the right to charge Our costs incurred as a result.

 

3.4    You shall be responsible for ensuring any goods supplied by Us under this Agreement are regularly serviced and maintained by an accredited engineer at least once a year. Your warranty may be invalidated should You fail to do this.

 

3.5    We will not be responsible for any costs associated with You failing to complete any of Your responsibilities under this Agreement or for faults that may arise from any existing system/ functionality or control issues that are not included in Your Quotation.

 

3.6    If some or all of the requirements We need You to comply with in relation to Your Installation are not satisfied within 30 days of the start date of this Agreement and We have not told You that You do not need to satisfy them, We may end this Agreement and We will reimburse any payments You have already made to Us.

           

4        Price and Payment

 

4.1    You shall pay the price for the Installation and goods as set out in Your Quotation.

 

4.2    We have different options for payment and will confirm the agreed payment method once You’ve accepted Your Quotation.

 

4.3    Where required under the agreed payment method terms, We may need You to make an up-front payment as set out in Your Quotation before We can commence the Installation. Where We have agreed to take an upfront payment from You and collect the Final Balance Payment upon completion of the Installation, We will need to carry out a credit check.  This credit check will create a record against Your credit file. If You fail this credit check We will need You to make full payment of the price to Us before We can commence the Installation.

 

4.4    Once We have completed the Installation, We will require full payment of any outstanding balance as set out in Your Quotation within seven days. If We do not receive full payment within seven days, We may commence debt recovery proceedings against You.

 

4.5    If You have applied for finance for the full cost of Your Installation through Our finance partner, We will not request any upfront payment from You before Your Installation commences.

 

4.6    Where You have applied for finance (either partially or in full) to cover the cost of Your Installation You must return a legible signed satisfaction note to Us within 14 days of completion of Your Installation.

 

4.7    If You do not return this satisfaction note in accordance with clause 4.6, Your finance application may no longer be valid or may be cancelled and payment in full may be requested from You to be made within seven days. Clause 4.4 will apply if payment is not made.

 

4.8    Once You have returned the signed satisfaction note, We will inform the finance partner and they will pay Us directly. You will need to consult Your credit agreement provider to confirm the nature of the repayment. If You agree to pay an amount upfront and apply for finance for the remainder, the upfront amount will need to be paid to Us the day your finance is approved.  If for any reason Your finance application is cancelled (for example, You cancel during the cancellation period under the credit agreement or by the lender) then You will be liable to pay for any part of the Installation that has been completed. See clause 5 for more details about Your cancellation rights under this Agreement.

 

4.9    Where We deliver any goods associated with Your Installation in advance these will be Your responsibility from the time We deliver them. You do not own these goods until We have received full payment for Your Installation as set out in Your Quotation.

 

4.10 If the rate of VAT changes between Your Quotation date and the date We begin Your Installation We will adjust the rate of VAT that You pay.

 

4.11 Once We have received the Final Balance Payment from You:

 

(a)     You will become the owner of and responsible for Your Installation. 

(b)     You will benefit from the guarantees and warranties for the parts of Your Installation as specified in Your Quotation. These guarantees and warranties will be for Your benefit and subsequent owners of Your property and will be valid for the period set out in each guarantee and warranty. These guarantees and warranties have their own terms and conditions and We recommend that You read them carefully to understand Your rights and obligations under them. 5        Ending this Agreement

 

5.1    In the event this Agreement is ended You shall allow Us access to collect any goods associated with Your Installation for which payment has not been made. Should access not be provided We shall be entitled to charge You for these goods. If full payment is not made within seven days We may commence debt recovery proceedings against You.

 

5.2    You shall have the right to end this Agreement if We fail to materially meet Our obligations under this Agreement.

 

5.3    You may cancel Your order for the Installation for any reason within 14 days following Your acceptance of this Agreement (Your ‘cooling off period’). However, if You request for or accept that the Installation starts within Your 14-day cooling off period (in accordance with clause 5.7) You shall:

 

(a)     if full performance of the Installation has been completed during Your cooling off period, lose Your right to cancel and bear all costs for Installation carried out; or

 

(b)     if partial performance of the Installation has been completed during Your cooling off period, pay Us an amount which is in proportion to the Installation already performed until You have communicated to Us Your cancellation from this Agreement in comparison to the full costs of the Installation as set out in Your Quotation.

 

5.4    If You cancel the Installation during Your cooling off period (and have not requested for or accepted that the Installation commences during this period) We will reimburse any payments already made to Us. Refunds will be made within 21 days of You notifying Us of Your right to cancel and will be made by the same means that payment was received from You unless otherwise agreed.

5.5    To exercise Your right to cancel You must inform Us either by phone on 0800 054 6250, or in a clear statement (Your ‘Notice to Cancel’) and sending this to either:

(a)     E.ON Energy Installation Services Limited, Westwood Way, Westwood Business Park, Coventry CV4 8LG; or

(b)     Salesteam@eonenergy.com.

You may use the template Notice to Cancel form provided in Schedule 1 for convenience.

5.6    Upon receiving a Notice to Cancel from You We will arrange collection of any goods that have been delivered to You in preparation of the Installation.

5.7    You may request or agree for the Installation to commence during Your 14-day cooling off period under this Agreement by completing and submitting the waiver form at Schedule 2.

 

5.8    If You are a finance customer and have exercised Your right to cancel Your credit agreement within the 14-day cancellation period afforded under that credit agreement, You will remain liable to Us for the cost of any of the Installation performed by Us.

 

6        Limitation of liability

 

6.1    Nothing in this Agreement shall limit or exclude Our liability for:

 

(a)     death or personal injury caused by Our (or Our sub-contractors) negligence;

(b)     fraud or fraudulent misrepresentation; or

(c)     any other provision which is not permitted to be limited or excluded by law. 

 

6.2    Our total liability to You in relation to this Agreement shall not exceed £25,000 (twenty-five thousand pounds). We shall not be liable for (whether in contract, tort breach of statutory duty or otherwise) any loss of profit, indirect or consequential loss arising in connection with this Agreement.

 

6.3    So far as the law allows the only warranties and/or terms which apply to the Installation are those set out within this Agreement.

 

7        Personal data

 

7.1    If You provide any personal data to Us under this Agreement E.ON Energy Installation Services Limited will be the ‘data controller’. Our Data Protection Officer can be contacted at Westwood Way, Westwood Business Park, Coventry, CV4 8LG.

8        Complaints

 

8.1    If We fail to deliver the standards of service You reasonably expect, We want to know about it so that We can put it right. Email Us at installationservicescomplaints@eonenergy.com or call Us or write to Us using the contact information above to discuss Your compliant. We will assess Your complaint and try to resolve things to Your satisfaction. If We can’t resolve Your complaint there and then, We will carry out a full review and aim to resolve Your complaint within eight weeks. Please see Our website for more details on how We aim to deal with complaints.

 

8.2    If We haven't resolved Your complaint after eight weeks, or We have sent You a final resolution letter (also known as a deadlock letter) to say there's no more We can do, You can refer Your complaint to the Utilities Alternative Dispute Resolution Service. It's a free and impartial service that sorts out disputes between companies and customers. You can get in touch with them via their website www.utilitiesadr.co.uk.

 

 

8.3    If Your complaint about the Installation could cause potential harm to You, Your possessions or members of the public We will escalate the complaint and will visit the site to resolve the issue within 24 hours.

8.4    If Your complaint relates to Our credit broking services (where We have introduced You to a credit lender), You may be able to refer Your complaint to the Financial Ombudsman Service.

9        Additional products

 

9.1    Additional terms and conditions may apply to add-on products (such as smart heating controls or servicing and maintenance plans) as listed in Your Quotation.  These terms and conditions can be found Schedule 3.

 

10     General provisions

 

10.1 Aside from intellectual property rights (trademarks, design rights, copyright, know how, business names etc) already owned by third parties all intellectual property rights associated with this Agreement shall be owned by Us.

10.2 Clauses 1, 3, 4, 5, 6, 7, 8, 9 and 10 shall all survive termination of this Agreement.

10.3 This Agreement including the Schedules, and Your Quotation is the entire Agreement between You and Us. 

 

10.4 Neither You or Us shall be responsible to the other for any failure to perform, delay in performing or imperfect performance of any of its obligations under this Agreement to the extent that this failure, delay or imperfect performance is due to a force majeure event (event or circumstance outside Our or Your reasonable control which cannot be prevented or avoided such as severe weather conditions).

10.5 If any part of this Agreement is found by any court to be invalid, illegal or unenforceable, that part shall not form part of this Agreement. The rest of the Agreement shall not be affected.

10.6 You shall not assign this Agreement without Our prior written consent. We shall be entitled to assign any of Our rights and benefits under this Agreement to any company within the E.ON SE group of companies.

10.7 The Contracts (Rights of Third Parties) Act 1999 shall not apply and no person other than You or Us shall have any rights under it.

10.8 This Agreement shall be subject to the laws of England and the exclusive jurisdiction of the English Courts, except that where the Installation is performed in Scotland you may bring a claim in the courts of Scotland.

2.       Eligibility

3.       How to Participate in the Offer

b)     purchasing a boiler online via our website by visiting eoninstall.com/boilers/get-a-quote (“Online Purchase”).

Whether using the Video Appointment or Online Purchase journey, you must quote the relevant discount code to be eligible for any discount.

With regards to the Video Appointment, you will receive a boiler quote which will include the total cost of the boiler and installation ("Quote").  You must notify the heating expert carrying out the Video Appointment of your intention to use the discount code for the purpose of your Quote. If the boiler is covered by these Terms and you are deemed to be eligible, the discount outlined above will be applied to your Quote and deducted from the total cost. Failure to notify the heating expert of your intention to use a discount code may result in the discount not being applied to your Quote, and discount codes may not be applied retrospectively.

For an Online Purchase, you will be shown the total price of the boiler and the installation ("Price"), you can choose to have this emailed to you. When you use the relevant discount code the discount outlined above will be applied to the Price. If you choose to have the Price emailed to you, ensure you have applied the correct discount prior to requesting the email so it reflects the price inclusive of the discount. The Price emailed to you will be valid for 30 days from the date that they are emailed.

This voucher covers our standard installation of a 7.4kW untethered charger. Standard installation includes installation of your charge point on a brick or plaster wall connected to your property, a maximum run of 10m of cable from the wall-mounted position to your consumer unit (fuse box), with no civil or remedial electrical work needed.

Any further installation or ancillary options above this standard installation would be chargeable at an additional cost. The address for the electrical vehicle charger installation must be the same address in which the solar solution installation is taking place.

2. Eligibility

This Offer is open to, ENE supply customers aged 18 years old or over:

a)       who book a free air source heat pump home video assessment (“Home Video Assessment”) by visiting eoninstall.com/heat-pumps/get-a-quote between 1st November 2022 and 31st December 2023 ((“Offer Period”); “Offer Period”;] and

b)      who complete their Home Video Assessment before 11:59pm on 31 December 2023

c)       who remain an ENE supply customer at the time of installation;

d)      who, within 30 days of receiving their email quote, have either (i) made their upfront payment or (ii) accepted the Terms and Conditions of their finance agreement; and

e)      who do not reside outside of the mainland UK or in Scotland and

All Home Video Assessments must be booked during the Offer Period and completed before 11:59pm on 31 December 2023. Home Video Assessments are subject to availability.

For Home Video Assessments, you will receive an air source heat pump quote which will include the total cost of the boiler and installation ("Quote").  You must notify the Heating Expert carrying out the Home Video Assessment of your intention to use a discount voucher for the purpose of your Quote. If the air source heat pump is covered by these Conditions and you are deemed to be eligible, £350 discount (as applicable) will be applied to your Quote and deducted from the total cost. Failure to notify the Heating Expert of your intention to use a discount code may result in the discount not being applied to your Quote.

The discount is not exchangeable for cash or any other alternative.

If you are an existing E.ON Next Energy Limited (CRN: 03782443) (“E.ON Next”) or a Sainsbury’s Energy supply customer, you are eligible for further discounts (the “Customer Discount”) as follows:

-        £200 off the price of a solar panel and battery installation;
