Changes to the Solar PV Feed in Tariffs following 12th December 2011 Deadline and 25th January Court of Appeal Update


In October the government announced a consultation on changes to the current Feed-in Tariff rates for Solar PV. The proposal was to cut the current rates paid to generators from 43.3p to 21p for installations below 4kW.

The current rates were only guaranteed up to the end of 11th December 2011, with anyone applying for Feed-in Tariffs after this date only receiving the current rate until 31 March 2012, they would then be moved to the new rate as of 1 April 2012.

Whilst this review has been on going the High Court and the Court of Appeal ruled (25th January 2012) that changing the rates in this way was “legally flawed”. The government is now seeking approval to appeal this in the Supreme Court.

If the government is unable to implement the 11th December proposal then a new date of the 3rd March 2012 is being proposed as a the date when newly registered installations will change to 21p after the 31st March. Installations before the 12th December are unaffected by these changes and will remain at the higher 43p rate for the term of their scheme.

Due to these proposals we have experienced a very high volume of calls and applications. We aim to continue offering our high level of customer service and answer calls and turn around applications as speedily as possible, but we have had to look at how we can continue to achieve this.

Which is why as of the 14th November 2011 if you are not an E.ON electricity customer and your current electricity supplier is a registered FIT supplier, we will no longer offer you our Feed-in Tariff service. A FIT registered electricity supplier is obliged to pay you your FIT tariff if you are their electricity customer and you may receive a more efficient service as you are already their energy customer.
